1.1 In these terms and conditions: End Users mean the individuals (whether for their personal use or on behalf of an organisation) that access the Website and/or use the information posted on the Website; we, our, us or SBN mean Sustainable Business Network Incorporated and are the owners of the Website; Registration Process means the completion of entering company details when commencing the assessment on the Website; Assessment means the series of online questions; Terms and Conditions means these Terms and Conditions; Website means www.getsustonline.org.nz
2.0 Terms & Conditions
2.1 By paying for Getsustonline.org.nz access, you are going to be given instructions on how to receive the passcode. The end user still must take it upon themselves to complete these steps and then the Assessment itself to get any benefits from this purchase.
2.2 By completing the Registration Process and by using the Website you are deemed to have accepted the Sustainable Business Network’s Terms and Conditions. If you do not accept any of the Terms and Conditions, you should not register on or log-in on the Website.
3.0 Fee, Payment & Registration Process
3.1 Getsustonline.org.nz purchases are annual subscriptions. After 12 months of use the passcode issued at purchase will expire. At that point the user may choose to renew the passcode.
3.2 We accept payment from the End User by credit card – Mastercard and Visa only – on the Sustainable.org.nz website order form. The End User will be notified when the payment is successful.
3.3 Passcodes cannot be shared with other organisations, and once used with a particular email address, will not be accepted unless matched with that same email address again.
3.4 Email addresses associated with the passcode can be updated manually to a new address upon request to the SBN. Email email@example.com.
3.5 Should you wish to no longer use the passcode before expiration of the 12 month period covered by the subscription fees, we will not be obliged to refund you for any money already paid, although we can expire the passcode at your request.
3.6 We reserve the right to change our fees from time to time
3.7 Any login issue experienced when using getsustonline.org.nz should be reported by emailing firstname.lastname@example.org
3.8 Passcode access gives the user the chance to answer questions as part of the assessment, and gives access to a full resource download, and assessment results and recommendations ‘Get Sust Snapshot Report’ download.
3.9 All downloads must be saved by the user – as they are not saved on the website server.
3.10 Upon completion of the registration Process you will be issued your passcode and you agree that you are solely responsible to protect that passcode and not to make it available to any other person.
3.11 The fees payable by the End User for each subscription shall be in New Zealand Dollars and include Goods and Services Tax.
4.0 Use of Assessment Results
4.1 Users acknowledge and agree that they arrive at any conclusion or decision by relying on their own judgement and may make decisions based upon their own interpretation of the information assessment results and form their own conclusions.
4.2 At no time will Sustainable Business Network, its directors, shareholders or any related company, person or organisation be liable for any reliance placed upon the results of the assessment.
5.1 The information you provide is used to prepare the online responses and Get Sust Snapshot Report. The data is stored for the express purposes of creating the report and to generate benchmarking data for use in the tool. All benchmarking is generic, by business size and business type only, and no businesses are named.
5.2 Data stored by SBN will not be made available to third parties. Should any organisational data regarding the businesses’ sustainability successes be noticed by SBN, the business may be approached by SBN to discuss creation of a case study to profile and celebrate the business.
5.3 Once the participant has downloaded the Get Sust Snapshot Report, privacy of the data in that report becomes the responsibility of the participant.
5.4 We may from time to time provide statistical or market research information to third parties for the purposes of monitoring or analysing market trends.
5.5 All information will be collected and held in accordance with the provisions of the Privacy Act 1993 and is particularly relevant to information about individuals. An individual may access the information that we hold about him or her by emailing a request to email@example.com
5.6 We are happy to discuss any concerns that you may have in providing the information that we require.
6.0 Liability & Indemnity
6.1 To the fullest extent permitted to by law, we shall not be liable for any loss or damage (whether direct or indirect) incurred as a result of the Assessment, assessment results, and information contained on the Website, including loss or damage from any incorrect answer or misinterpretation
6.2 To the fullest extent permitted to by law, SBN shall not be liable for any loss or damage (whether direct or indirect) incurred as a result of any person, body or completing the Assessment on behalf of a different person, body or organisation
6.3 The Suppliers hereby indemnifies and will hold harmless Sustainable Business Network against and release us from all actions, demands, claims, fines, taxation, damages, losses, costs (including legal fees on a full client solicitor basis) and any other liability whatsoever (hereafter referred to as Claims) arising out of our Assessment, resource, or subsequent results, by the End User or its directors or employees due to their failure to comply with any of the End User obligations under these Terms and Conditions
7.0 Changes to Website Content
7.1 SBN reserves the right to make change to any information on the Website, including listing prices on the sustainable.org.nz order form, at any time without prior notice.
8.0 New Zealand Courts & Disputes
8.1 These Terms and Conditions shall be governed by the laws of New Zealand and you hereby submit to the non-exclusive jurisdiction of the Courts of New Zealand.
8.2 Any disputes arising as a result of the Website will initially be dealt with through Mediation.
8.3 Nothing prevents any party from approaching the Courts of New Zealand for injunctive relief.
